Here is some useful information regarding how to determine if and what type of penalty you actually have:
Panda for the most part takes it cues from on-page issues such as keyword density and site-wide links etc. The Panda penalty is an automated process, and not a manual penalty.
A Penguin penalty will be caused by an unnatural link profile, or other external issues.
Please note that unless you have some negative SEO on your site that the Disavow tool will not be needed.
